This Privacy Policy (“Policy”) describes the information which Avinash Anand (“I”, “Me”, “My”, “Mine”, “Services”, “Website”) collects from you when you download, access, or use its website (“My Site”) for delivery of information, products, offerings and content via any mobile or internet connected device or otherwise (collectively the "My Services").

This Privacy Policy should be read in conjunction with the Terms of Use applicable to My Website that you are using.

Privacy choices you have made on the third-party site or platform will not apply to My use of the information I have collected directly through My Site. Please also keep in observance that My Site and applications may contain links to other sites not owned or controlled by Me and I am not responsible for the privacy practices of those sites. I encourage you to read the privacy policies of such other sites, they may collect your personal information.

All capitalized terms that have not been specifically defined herein shall have the same meaning as provided under the Terms of Use.

By using My Website Services (for example, when you communicate with me, on My site or applications or through social media), you agree and provide consent to My collection, use and share your personal information as described in this policy.

Accessing Site and My Services through VPN

You should not access or use the Site or My Services by means of any mechanism or technology which conceals your actual geo-location or provides incorrect details of your location (for example, use a virtual private network (VPN) to access My Services, proxy server).

I will not be responsible or liable for any collection, storage or processing of your personal information or data if you use any mechanism or technology to access or use Site or My Services which conceals your actual geo-location.

COLLECTION AND USE OF PERSONAL INFORMATION

I may collect additional information (for example, your name, e-mail id, mobile number, location etc.,) at other times, including but not limited to, when you provide feedback(s), modify your content or email preferences, respond to surveys, provide comments, or communicate with Me.

B. Information automatically collected while browsing/navigating through the Site

The Site uses cookies and other similar technologies which are necessary to its functioning and to provide My Services. Some of these cookies are essential for Me to provide you with my services.

To improve the responsiveness of the Site for my Users, I may use "cookies", or similar electronic tools to collect Information to assign each visitor a unique, random number as a User Identification (User ID) to understand the User's individual interests using the identified computer or device. Unless you voluntarily identify yourself (through registration, for example), I will have no way of knowing who you are, even if I assign a cookie to your computer or device. The only personal information a cookie can contain is information you supply. A cookie cannot read data off your hard drive or device. My advertisers may also assign their own cookies to your browser (if you click on their ads etc.), a process that I do not control. I receive and store certain types of Information whenever you interact with My Site or Service though your computer/laptop/netbook or mobile/tablet/pad/handheld device etc.

Opting out

If a User opts out using the Ads Settings, the unique DoubleClick cookie ID on the User's browser is overwritten with the phrase "OPT_OUT". Because there is no longer a unique cookie ID, the opt-out cookie can't be associated with a particular browser.

You can opt-out of Google Analytics for display advertising and customize Google Display Network ads using the Ads Settings options provided by Google

If you are interested in opting-out from specific interest-based ads, you can opt-out through the privacy policy page or opt-out by writing to me. If you have opted out, you will not obtain personalized ads from me.

C. Inferred Information through usage and log data

I may track certain information about you based upon your behavior on my Services. I use this information for conducting internal research on My users' demographics (such as age, gender), devices, interests, and behavior to better understand, protect and serve My users.

I may also collect your Information to track user behavior and preferences for internal analytics and research. I may also use your information:

To evaluate your interest in various genres of content, services, offers;
To perform analytics and conduct customer research, to determine your interest, for identifying content that generates sales and to analyse traffic patterns.

If you choose to post messages on social media accounts, message boards, chat rooms or other message areas or leave feedback, i will collect that information you provide to me. I may retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems and to comply with legal obligations under the applicable laws.

The above information may also be captured by keeping cookies on My Site by My affiliates for the purposes mentioned above.

D. Information I collect from third parties

Information obtained from other Sources

I may receive information about you from other online sources. I may add it to My account information system and treat it in accordance with this policy. If you provide information to the platform provider or other partner to whom I provide services, your account information including may be passed on to Me. I may obtain updated contact information(s) from third parties in order to correct My records and fulfil the Services or to communicate with you or share the information with any third party.

Information obtained from Third party Sites

If you link, or connect to My Services account with a third party services they may send Me information such as your registered e-mail id and public profile information from the service as stated below;

Meta (Facebook, Instagram, WhatsApp, Threads) –Email ID and public profile information which may include name, profile picture, age, gender etc.
Alphabet (Google, Gmail, YouTube, etc.) –Email id, language preference and age.
X (Formerly Twitter) – Email id, public information which may include name, profile picture, etc.

Demographic and other information

I may reference other sources of demographic and other information in order to provide you with more targeted communications and promotions. I use various third party analytics service providers, among others, to track the user behavior on My Site. They are used to support display advertising towards helping Me gain understanding of My users' Demographics and Interests. The reports are anonymous and cannot be associated with any individual personally identifiable information that you may have shared with Me.

Subscription or Paid service data

When you choose any subscription or paid service, I or My payment gateway provider may collect your personal information such as address or billing information, including your credit/debit card number and expiration date etc. The subscriptions or paid Services may be on auto renewal mode unless cancelled. If at any point you do not wish to auto-renew your subscription, you may cancel your subscription before the end of the subscription term or contact Me on My support e-mail.

Transactional/ Billing information

Based on your purchase of a subscription or paid service, My payment gateway partner may collect information, including but not limited to, your credit/debit card details or other bank account details along with your billing address. This information is stored by the payment gateway partner. For instance, the Services will be using third party payment gateway partners to process and facilitate the payment of your subscription fee to the Services for providing you access to the subscription; such payment gateway partners are not controlled by Me. When you visit such payment gateways you do so at your own risk. I encourage you to familiarize yourself with the privacy statements provided by such payment gateways prior to providing them with information about you or entering into any transactions with them. I do not assume any responsibility or liability for such payment gateways, the content of such payment gateways and their privacy practices, nor do I endorse them.

I may receive financial or transactional information (for e.g., transaction ID, etc.) from third party vendors in case of payments, for reconciliation and validation of transactions and also for the purpose of resolutions of complaints (in case of failed transactions and refunds).

PURPOSES FOR COLLECTING, PROCESSING AND DISCLOSING YOUR PERSONAL INFORMATION

I use information to provide, analyze, administer, enhance and personalize My service and marketing efforts, to process your registration, to provide you services, and to communicate with you related to below mentioned points. For example, I may use information to:

Information Use by Me

The Information supplied by you enables Me to improve my services and provide you the most user-friendly experience(s). In some cases, for e.g. provision of certain service(s) or utility (ies), I may require your contact information as well. All required information is service dependent and I may use the above said user Information to, maintain, protect, and improve the Services and for developing new services.

I may also use your email address or other personally identifiable information to send commercial or marketing messages about My Services and/or such additional updates and features about third parties products and services with an option to subscribe / unsubscribe (where feasible). I may, however, use your email address for non-marketing or administrative purposes (such as notifying you of major changes, for customer service purposes, billing, etc.)

Any personally identifiable information provided by you will not be considered as sensitive if it is freely available and / or accessible in the public domain like any comments, messages, blogs, scribbles available on social platforms like Facebook, twitter etc. Any posted/uploaded/conveyed/communication by users on the public sections of the " My Site" becomes published content and is not considered personally identifiable information subject to this Privacy Policy. In case you choose to decline to submit personally identifiable information on the Sites, I may not be able to provide certain services on the Sites to you. In any case, I will not be liable and or responsible for the denial of certain services to you for lack of you providing the necessary personal information.

When you register with the Application or Services, I may contact you from time to time about updating your personal information to provide you features that I believe may benefit/interest you.

Information sharing with legal authorities, affiliates

I may share your information with any third parties without obtaining the prior consent of User in the following limited circumstances:

When it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing these Terms or for complying with the applicable laws and regulations.

Disclosure to Third parties

Service Providers

The Application may include links to other Sites or applications (for e.g., links to payment gateways for payment of subscription fees). Such Sites or applications are governed by their respective privacy policies, which are beyond My control. Once you leave My servers (you can tell where you are by checking the URL in the location bar on your browser), use of any information you provide is governed by the privacy policy of the operator of the application, Site you are visiting. That policy may differ from mine. If you can't find the privacy policy of any of these sites via a link from the Site homepage, you should contact the application/Site owners directly for more information.

Advertisers

When I present Information to my advertisers -- to help them understand our audience and confirm the value of advertising on My Site -- it is usually in the form of aggregated statistics on traffic to various pages / content within My Site. I use third-party advertising companies to serve ads when you visit My Site. These companies may use Information (excluding your name, address, email address or telephone number or other personally identifiable information) about your visits to this and other Sites or applications, in order to provide advertisements about goods and services of interest to you. I do not provide any personally identifiable information to third party advertisers / ad-servers without your consent.

Business transfers

I provide personal information to My affiliates and other trusted businesses or persons to process it for me, based on My instructions and in compliance with My Privacy Policy and any other appropriate confidentiality and security measures.

Third Party Surveys, Promotional Activities conducted on Site

Surveys, promotional activities might be conducted on My Site by associated third party vendors directly. Your personal information such as name, email, phone number, IP address, country code etc., may be captured by the vendor, in case you provide the details for participation in the Survey, promotional activity. Please note that the personal information may be shared between me and vendors for processing and deriving insights from the survey results, promotional activity.

LINKS TO THIRD PARTY SITES / AD-SERVERS

My Site may include links to third party Sites, applications and ad servers. The collection of your information including but not limited to PII by such Sites, applications and/or ad servers are governed by their respective privacy policies, which are beyond my control. Their privacy policy may differ from mine.

You may share your Information regarding your activities on Sites with third party social Sites to populate your social wall that is visible to other people.

DATA RETENTION AND ERASURE

How long do I store and use your Information

I retain the information which I have collected no longer than is necessary. This is determined on a case by case basis. Normally I will retain the information as long as you maintain conversation with me and till the time you continue to access and use My Services. I will delete your information as soon as reasonably possible, based on your activity and in accordance with applicable law(s), whenever you request Me to do so. However, I may archive and/or retain some information for legal purposes.

When you use the Services or Site (or any of its sub sites), I make good faith efforts to provide you, as and when requested by you, with access to your personal information and shall further ensure that any personal information or sensitive personal data or information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. I ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and I may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case, where I provide information access and correction, I perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way I maintain certain services and/or due to requirements under applicable laws for retaining or preserving information, after you delete your information, such information and/or residual copies may take a period of time before they are deleted from my active servers and may remain in my backup systems.

Data Erasure

I retain your personal information as long as necessary for me to provide services to you or you ask Me to not retain your data. If you no longer want Me to use your information then you can request that I erase your personal information as soon as reasonably possible, based on your activity and in accordance with applicable law(s)..

I may retain some of your personal information as necessary for My legitimate business interests, such as fraud detection and prevention and enhancing safety.

I may retain and use your personal information to the extent necessary to comply with My legal obligations.

Information you have shared with others (e.g., Reviews, testimonials) may continue to be publicly visible on my site. However, attribution of such information to you will be removed. Additionally, some copies of your information (e.g., log records) may remain in My database, but are disassociated from personal identifiers.

Because I maintain copies of personal information to protect from accidental or malicious loss and destruction, residual copies may take a period of time before they are deleted from My active servers and may remain in My backup systems.

You can request for deletion of your information by writing to me, via in writing or through email signed with the electronic signature.

Further, I may retain and use Your personal information to the extent necessary to comply with My legal obligations.

CHILDREN’S PRIVACY

My Site is not intentionally designed for or directed at persons less than 18 years of age. I do not knowingly permit any person who is under 18 years of age to register with the services or to provide any other personally identifying information. If I become aware or get notified that any personally identifiable information of persons less than 18 years of age has been collected on My Site without verified parental consent, then I will take the appropriate steps to delete any such information.

However, I consider it the responsibility of parents to monitor their children’s use of My services. Nevertheless, it is My policy not to collect and process any personal information from children below 18 years of age or offer to send any promotional materials to persons in that category. I do not seek or intend to seek or receive any personal information from children. Should a parent or guardian have reasons to believe that a minor has provided me with personal information without their prior consent, please contact me to ensure that the personal information is removed from my website.

SECURITY MEASURES

I take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of My data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where I store personal data. All information gathered is securely stored within the host controlled database. The database is stored on servers secured behind a firewall on the cloud; access to the servers is password-protected and is strictly limited. However, as effective as My security measures are, no security system is impenetrable.

UPDATES & CHANGES

I may alter My privacy policy from time to time to incorporate necessary changes in technology, applicable law or any other variant. I reserve the right to amend the terms of this Policy from time to time. Any changes I make will be effective immediately on notice, which I may give by posting the new policy on the Site. Your use of the Site or Services after such notice will be deemed acceptance of such changes. I may also make reasonable efforts to inform you via electronic mail. In any case, you are advised to review this Policy periodically on the Sites to ensure that you are aware of the latest version

GRIEVANCE REDRESSAL

Redressal Mechanism: Any complaints, abuse or concerns with regards to the use, processing, deletion and disclosure of Information provided by you or breach of these terms should immediately be informed to me via email".

I request you to please provide the following information in your complaint/Grievance:-

a) Identification of the information provided by you;

b) Clear statement as to whether the information is personal information or sensitive personal information;

c) Your address, telephone number or e-mail address;

d) A statement that you have a good-faith belief that the information has been processed incorrectly or disclosed without authorization, as the case may be;

e) A statement, under penalty of perjury, that the information in the notice is accurate, and that the information being complained about belongs to you;

f) You may also contact us in case you have any questions / suggestions about the Policy using the contact information mentioned above.

The Company may reach out to you to confirm or discuss certain details about your complaint and issues raised.

I shall not be responsible for any communication, if addressed, to any other person in this regard.
